1. Acceptance of Terms

By accessing or using Elevat3, you agree to be bound by these Terms and this Privacy Policy. If you do not agree, you may not use the app.

2. Eligibility

• You must be 18 years or older to use Elevat3.
• By using the app, you confirm that you are legally an adult in your jurisdiction and agree to these Terms.
• MindFuse, Inc. is not liable for any use of the platform by individuals who do not meet these eligibility requirements.

3. Nature of the Service

• Elevat3 provides AI-guided self-coaching and wellness support.
• It is not a substitute for professional medical, mental health, or legal services.
• The AI Coach is a virtual assistant and not a licensed professional. All interactions are automated and informational only.

4. How Elevat3 Uses AI

Elevat3 uses third-party AI services to power your coaching. Nothing is sent to these providers until you have given your permission in the app.

• What is sent: your chat messages, coaching context such as your first name, goals and journal highlights, and any voice audio you record or speak in a live session.
• OpenAI receives this data to generate your coach's replies and to transcribe your voice messages.
• ElevenLabs receives audio to power live voice conversations and to produce your coach's spoken voice.
• Both act on our behalf and only to deliver the service, under data-protection terms providing protection equivalent to this policy.
• Your data is never used to train their models, never used for advertising, and never sold.

5. No Professional Advice

All content provided is for general information and personal development purposes only.

You acknowledge and agree that:

• We do not provide diagnoses, therapy, or mental health treatment.
• We do not offer medical, legal, or financial advice.
• You are solely responsible for how you interpret and act on the information provided.

6. International Use

Elevat3 is accessible globally. However:

• You are responsible for ensuring your use complies with local laws in your country.
• MindFuse, Inc. makes no guarantees that content or features are legal or appropriate outside the United States.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• MindFuse, Inc. is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app.
• We disclaim responsibility for any actions, decisions, or outcomes resulting from your interaction with the AI Coach.
• You use the platform at your own risk and discretion.

8. User Responsibility

You agree to:

• Use the app only for lawful, personal purposes.
• Keep your login credentials confidential and secure.
• Refrain from attempting to misuse, reverse-engineer, or manipulate the AI or platform.
• Be truthful in your interactions to ensure the best experience.

9. Content Ownership

• All content, tools, AI logic, prompts, designs, and intellectual property within Elevat3 are owned by MindFuse, Inc.
• You may not copy, reproduce, distribute, or repurpose any part of the platform without written permission.

10. Termination

We reserve the right to suspend or terminate your access without notice if:

• You violate these Terms or applicable laws.
• You misuse the app or its features.
• Required by law or government request.

11. Data Privacy & Security (Privacy Policy)

What we collect and how: when you create an account you provide your name, email address and age range, and you may optionally add your country. As you use Elevat3 you may also provide chat messages to your AI coach, voice recordings, journal entries, goals, wellness check-in answers, and an optional profile photo. We also collect basic usage data such as feature usage and session activity automatically.

How we use it: this data is used solely to operate and improve Elevat3 — generating coaching responses, transcribing your voice, producing your coach's spoken replies, summarizing your journal, tracking your goals and wellness trends, and personalizing your experience.

Third-party AI processors: OpenAI and ElevenLabs process some of this data on our behalf to deliver the coaching, transcription and voice features. Section 4 sets out exactly what is sent to each, and the app asks for your explicit permission before anything is sent.

• We do not sell or rent your personal data, and we never share it with third parties for advertising.
• All data is encrypted in transit and at rest using modern standards.
• You can delete your account and all associated data directly in the app (Profile → Delete Account), or request deletion by emailing [email protected].

12. Updates to These Terms

We may revise these Terms and this Privacy Policy occasionally. When we do:

• Updates will be posted in the app.
• Continued use after changes means you accept the updated version.
